Right to Work Checks Guidance
Right to work checks are key to an employer fulfilling their legal responsibility to ensure their employees have the correct immigration status and are allowed to work in the UK. Checks are essential to ensure the employer isn’t held liable if an employee is found to be without the right to work.
New guidance has been issued this month for employers and HR departments on carrying out document checks. You should use it to find out:
- what a right to work check is
- why you need to do right to work checks
- whose documents you should check
- how to carry out checks
- when to carry out initial checks, follow-up checks and what happens under TUPE
- what documents are acceptable
You can see the full guidance document here.
Checking Documents Online
Changes to processes have also been outlined in response to Covid-19 and the restrictions that are still in place. These changes still enable employers to:
- Carry out checks over video calls
- Job applicants and existing workers can send scanned documents or a photo of documents for checks using email or a mobile app
- employers should use the Employer Checking Service if a prospective or existing employee cannot provide any of the accepted documents
